Amicus brief in StandWithUs Center for Legal Justice v. Massachusetts Institute of Technology warns that the decision below leaves Jewish students without a civil-rights remedy

ATLANTA, GA — The National Jewish Advocacy Center filed an amicus curiae brief in the Supreme Court of the United States on behalf of U.S. Senators Ted Cruz and Rick Scott, and NJAC itself, in support of the petitioners in StandWithUs Center for Legal Justice v. Massachusetts Institute of Technology, No. 25-1404. The brief urges the Court to grant certiorari and review a decision of the U.S. Court of Appeals for the First Circuit.


NJAC argues that the decision below announces two legal rules that, in combination, withdraw the protection of Title VI of the Civil Rights Act of 1964 from Jewish students. The first treats a harasser's subjective discriminatory intent as an element of a hostile-environment claim. The second holds that speech which would be protected against direct government suppression categorically cannot form the basis of a Title VI claim.
